出版的实质是复制发行作品,是使用作品的一种方式,也是传播作品的主要途径。要做好出版工作,其基本前提就是要充分尊重作者依法对作品享有的各种权利。为此,笔者从出版者的角度,谈谈出版工作中的几个著作权问题。一.出版他人作品,必须依法取得著作权人的授权作者对其创作的作品有权自己使用或许可他人使用,这是著作权法确定的基本原则。出版权(复制发行权的统称)是作者因创作作品而享有的诸项权利之一。因此,图书、报刊出版者要使用作品的出版权,就必须取得作者授权,否则就会侵犯作者的合法权益,并承担相应的法
