我国军事法体系有一个非常重要的组成部分,那就是军事法规。中央军委是权利的行使者,人民是权利的拥有者,而这种权利在民主政治的背景下就是军事法规制定权。军事法规对着维护国家的统一、遏制权利扩张和维护军事法的平衡方面有着重要的作用,所以国家很有必要去建立自己的军事法规。然而目前建立完善的军事法规有着一定的难度,不仅仅是它本身具有一定程度的保密性,而且它制约军事权却只能在抽象层面上。
