彩礼返还是常见的婚姻家庭纠纷,尤其是在我国的农村地区。我国婚姻法司法解释(二)虽进行了规制,但由于传统理论根基的不合时宜和法条本身的诸多漏洞,致使实务中纷争不断,因而有必要予以重新审视。本文试图结合社会学、人类学、经济学等相关理论与知识,围绕彩礼担保、资助的功能对彩礼赠与的法律属性进行合理定位,进而在此定位基础上阐释现行法律规制的不足,并参考现实案例中的情形提出完善建议。
