改革开放三十多年来,我国经济迅速发展和居民生活水平大幅提高的同时,城市规模急剧扩大,城市地价、房价也快速上扬,在这种住房需求刚性和房价持续膨胀的矛盾中,“小产权房”就随之产生而且发展迅速。小产权房由于其城郊的地理位置和相对低廉的价格而受到城市中工薪阶层的青睐,然而不可否认的是,小产权房是存在法律风险的,而且在小产权房上的种种违法问题也引起了相关部门的注意。因此,笔者结合我国目前小产权房的现状,分析了小产权房的相关问题,并提出相应的规制小产权房的法律途径。
