经济基础决定上层建筑,我国的法律文化伴随着经济基础的变化而发展,从小农经济时期的传统法律文化到计划经济时期的社会主义法律文化再到市场经济时期的现代法律文化。法律文化是与法有关的制度、意识、学说的总体,随着社会的进步,它从落后的人治社会、非法律信仰、义务本位到现在的依法治国、树立法律信仰、权利本位。本文将以经济的变化为脉络,同时从一些侧面简要分析法律文化的变迁。
The economic foundation decides the superstructure. The legal culture of our country develops along with the change of the economic base. From the traditional legal culture in the period of petty peasants to the socialist legal culture in the period of planned economy to the modern legal culture in the period of market economy. With the progress of society, the legal culture is the overall system, consciousness and doctrine related to the law. With the progress of society, it sets the legal faith and the right standard from the backward people-based society, non-legal beliefs and obligations to the current rule of law. This essay will take the change of economy as a context, and at the same time, briefly analyze the changes of legal culture from some aspects.
