本刊自今年第九期刊登一组判案评论文章以来,编辑部收到不少读者的来信。绝大多数读者对“判案评论”的研究形式表示赞赏,并附寄了不少可供研究的已决案例。本期讨论的“骨灰案”是业经二审终审的判案,判决虽已生效,但其中有不少实体和程序等问题可以研究。故我们根据有关方面的建议,在隐去一、二审机关名称及当事人真实姓名后予以刊登,并选用了四篇评论文稿,供大家参考。
Since the publication of a series of judgments articles in the ninth issue of this year, the editorial department has received letters from quite a few readers. The vast majority of readers expressed their appreciation for the study on the “Judgment Criticism,” and enclosed a number of completed cases for research. The “case of ashes” discussed in this issue is the adjudication case that has been adjudicated in the second instance. Although the verdict has taken effect, many substantive and procedural issues can be studied. Therefore, according to the suggestion of the parties concerned, we published the name of the first and second instance authorities and the real names of the parties after they were hidden, and selected four review papers for your reference.
