草原生态补偿法律机制是通过法律构建的,受益主体对因草原生态环境保护付出代价对象进行必要补偿的调整机制。其中的“代价”不仅指草原生态建设与保护成本,亦包括为养护草原而放弃的机会成本。本文从辽宁省草原生态补偿法律机制的现状入手,分析其法律层面及实务中存在的问题,进而提出健全辽宁省草原生态补偿法律体系、构建多样化草原生态补偿模式、提升草原生态补偿标准、完善草原承包经营法律制度的对策。
The legal mechanism of grassland ecological compensation is constructed through law, and the beneficiary body adjusts the necessary compensation for the cost of grassland ecological environment protection. Among them, the “price” not only refers to the cost of ecological construction and protection of grasslands, but also includes the opportunity cost of giving up for the conservation of grasslands. This paper starts from the status quo of the legal mechanism of grassland ecological compensation in Liaoning Province and analyzes the problems existing in the legal aspects and practices of the grassland in Liaoning Province. Then, it puts forward to improve the legal system of grassland ecological compensation in Liaoning Province, construct a variety of grassland ecological compensation model, improve grassland ecological compensation standard, Countermeasures of Legal System of Grassland Contracting Management.
