我国《物权法》确立了对物权的平等保护原则。在此原则下对国家物权进行保护,首先必须树立平等的保护观念。其次,物权法通过物权范围、物权行使、物权保护等的特别规定,赋予了国家物权特殊的地位。应该正确运用这些规定,保护好国家的物权利益。再次,还应该加紧制定科学的物权法配套措施,使国家物权的保护更具体化。
China’s “Property Law” established the principle of equal protection of real rights. Under this principle, to protect the state property rights, we must first establish an equal protection concept. Second, the Property Law gives the state a special status by the special provisions of the scope of real rights, the exercise of real rights and the protection of real rights. These regulations should be correctly used to protect the interests of real rights in the country. Thirdly, we should step up the formulation of scientific supporting measures for property law to make the protection of state property more specific.
