新闻作品有别于时事新闻,应受《著作权法》的保护,我国《著作权法实施条例》对“时事新闻”的简约解释则没有结合新闻界的具体情况,导致“时事新闻”的范围常被扩大。关于“时事新闻”的定义,法学界与新闻学界从未形成过统一的意见,两者对“时事新闻”概念存在严重分歧。长期以来各类新闻作品的著作权得不到有效的保护,严重损害了著作权人的合法利益。
