鉴定结论是指诉讼中司法机关为了解决案件中某些专门性问题,依据其职权或者依据双方当事人的申请,委托或聘请具有鉴定资格的鉴定机构或者鉴定人,对案件待证事实的专门性问题进行分析、鉴别和判断后所作的结论性意见。[1]在基层司法实践中,故意伤害和交通肇事案件发案率高,而对这两类案件不可避免地要对鉴定结论进行审查。
