在构建和谐社会的目标下,当代中国检察官的职业如何准确定位,这是一个很大也很难回答的题目。因为此问题不仅涉及到中国检察制度、检察官客观义务的起源,还涉及到国家整体权力的划分,涉及到我国的司法传统以及建设法治国家的现实状况。但是,在我们要求检察机关加强法律监督能力建设,呼吁检察官为构建和谐社会发挥重要作用的时候,我们就会感到,这一问题实际上是一个不可回避的基础性的理论问题。
Under the goal of building a harmonious society, how to accurately define the position of prosecutors in contemporary China is a big and difficult topic to answer. Because this issue involves not only the procuratorial system in China, the procurator’s objective obligations, but also the division of the overall power of the state, the judicial tradition in our country and the reality of building a state under the rule of law. However, when we ask the procuratorial organs to strengthen the capacity of legal supervision and appeal to prosecutors to play an important role in building a harmonious society, we will feel that this issue is actually an unavoidable basic theoretical issue.
