对南海海域的掠夺式开发,致使海域污染事故频发,海洋生态遭受破坏,南海海域生态修复刻不容缓。生态修复涉及到大量的资金投入,目前的法律法规没有明确规定海域生态修复的责任主体,因此,应当构建海域污染行为人作为主要责任主体,国家作为南海海域的所有权人,在一定情况下承担补充责任的机制。同时国家应该创设条件将受益的投资人、保险公司也纳入到南海海域的生态修复责任主体中,实现南海海域生态文明建设的良性发展。
The predatory exploitation of the South China Sea has resulted in frequent pollution incidents in the sea and the destruction of marine ecology. The ecological restoration in the South China Sea requires urgent consideration. The ecological restoration involves a lot of capital investment. Currently, the laws and regulations do not clearly stipulate the main body of responsibility for ecological restoration in the sea area. Therefore, the perpetrators of pollution in the sea area should be constructed as the main responsibility entities. As the owner of the South China Sea area, the state can assume supplements under certain circumstances Responsibility mechanism. At the same time, the state should create the conditions for the benefit of investors, insurance companies are also included in the responsibility of the ecological restoration of the South China Sea to achieve the healthy development of the ecological civilization in the South China Sea.
