城市化进程中因征地拆迁而引发的矛盾冲突频繁,其中如何补偿的问题是最具争议性的问题之一。《国有土地上房屋征收与补偿条例》提出了“市价补偿”的标准,在一定程度上解决了城市房屋拆迁的补偿问题。农地征收应当采用何种标准?《土地管理法》应当作出何种修改?有必要对“耕地平均年产值”、“公平市场价值”、“土地价值”等补偿依据进行分析和思考,提出具体立法建议。
The contradictions and conflicts arising from the land acquisition and demolition in the process of urbanization are frequent and the issue of how to compensate is one of the most controversial issues. The Regulations on the Collection and Compensation of Houses on State-owned Land put forward the standard of “market price compensation”, to a certain extent, solved the compensation problem of urban house demolition. What standards should be adopted for the collection of farmland? What amendments should be made to the Land Management Law? Compensation basis for “average annual output value of arable land”, “fair market value”, “land value”, etc. Analysis and thinking, put forward specific legislative proposals.
