持有“银行汇票”、“商业汇票”、“银行承兑汇票”、“银行本票”、“支票”的单位因保管不善,将票据丢失、被盗或丧失,持票人可以到付款人或代理付款人处挂失止付,并在挂失止付后向人民法院申请公示催告;也可以直接向法院申请公示催告或提起诉讼。允许挂失止付的票据有:填明“现金”和代理付款人的银行汇票;填明现金的银行本票;要素填写齐全的支票;已承兑商业汇票。不允许挂失止付的票据有:未填明“现金”和代理付款人的银行汇票;未填明“现金”的银行本票。
