根据我国高等教育体制,高等学校分为公办和民办两大类。现行法律、法规没有对利用非财政性国有资金举办的高等学校(简称行业高等学校)的法律性质、与教师的法律关系等作出明确规定。本文试作探讨,认为行业高等学校属于民办高等学校,与教师的法律关系是劳动合同关系。
According to China’s higher education system, colleges and universities are divided into public-run and private-run two categories. Current laws and regulations do not clearly stipulate the legal nature of higher education institutions (colleges and universities of higher learning) held by non-state-owned state-owned funds and the legal relationship with teachers. This article attempts to explore the higher vocational colleges that belong to private colleges and universities, the legal relationship with teachers is the employment contract.
