宅基地使用权抵押是指将宅基地或宅基地上的建筑物以及附属物作为债权设定担保,在农户无法偿还债务的情况下,以抵押物优先受偿债权的形式。我国《物权法》、《土地管理法》、《担保法》和国家的相关政策都禁止宅基地使用权流转,即宅基地使用权的买卖、赠与、入股、抵押等均不允许。但随着形式的发展,农村宅基地使用权抵押问题显得越来越迫切,也极具可行性。
