我们终究冲破了固有理论的禁锢,真正地面对中国的现实了。政府作为一个有组织的权力系统,不可避免地充当市场组织者的角色,而政府权力的界定,政府干预和组织市场的方式都必须通过法律规定,有的还要由宪法加以确认。现行宪法与变动不居的社会现实相脱节的地方还有不少,如果不注入新的内容,深化改革就会因为与宪法相冲突而受到阻碍,即使制定出新的各项保障、促进市场经济发展的法律和法规也仍然没有宪法依据。
