依法治国是现代国家长治久安的一项根本举措,可在人情、面子和“亲亲尊尊”之宗法礼制观念根深蒂固的乡土中国,传统礼治秩序与现代法治观念之间的冲突不断。在新时期传统日益回归的大环境之下,中国农村地区“差序格局”下的“人情社会”这一典型结构性特征更是顽强地得以延续下来。在乡土中国广大农村地区推行法治建设面临诸多问题。分析乡土中国农村法治建设现状及存在的主要问题及成因,研究地方权威、差序格局和礼治秩序对于当代乡土中国深入推行法治建设,无疑是有着重要的现实意义的。
Ruling the country by law is a fundamental measure for the long-term peace and security of the modern nation. Conflicts between the traditional order of rites and the modern concept of the rule of law continue in the native China where the concept of patriarchal rituals of humankind, face-saving and “pro-esteem” are deeply rooted. Under the general environment of the return of tradition in the new era, the typical structural features of “human society” under the pattern of “differential order” in China's rural areas are tenaciously continued. There are many problems in promoting the construction of the rule of law in vast rural areas of China. It is undoubtedly of great practical significance to analyze the status quo, main problems and causes of rural rule of law in rural China, and to study the local authority, the pattern of difference and the order of ruling by law.
