媒体监督在促进司法公正、遏制司法腐败方面发挥了积极作用。一方面,媒体监督权的充分行使是宪法规定的基本权利的实现,另一方面,审判独立最终的核心要求法官独立断案。媒体监督一旦缺乏制约或运用不当便可对司法公正造成负面影响,从侧面妨碍或破坏司法公正。媒体监督与审判独立在宪政意义上是统一的,两者共同追求的目标是司法公正,如何正确调和媒体监督与审判独立的关系,使两者在维护司法公正的道路上相辅相成显得极为重要。
Media supervision has played a positive role in promoting judicial fairness and curbing judicial corruption. On the one hand, the full exercise of the power of media supervision is the realization of the basic rights stipulated in the Constitution. On the other hand, the final core of the trial requires that the judge judge the case independently. Once the lack of control or misuse of media supervision, it can have a negative impact on the justice of the judiciary and hinder or undermine justice from the side. The media supervision and trial independence are unified in the sense of constitutionalism. The common pursuit of both media is judicial justice. How to correctly reconcile media supervision and trial with the independent relationship makes it very important to complement each other on the road of safeguarding judicial justice.
