修改后刑诉法实施以后,外国人犯罪案件可以由基层人民检察院负责审查起诉,这给基层人民检察院带来了全新的挑战。本文根据修改后刑诉法实施半年来办理外国人犯罪案件的情况出发,提出新刑诉实施以来基层检察院在办理外国人犯罪案件中遇到的有关问题,继而探讨相关应对措施。
After the implementation of the amended Criminal Procedure Law, criminal cases involving foreigners can be prosecuted and prosecuted by the people’s procuratorate at the grass-roots level. This poses a brand new challenge to the grass-roots people’s procuratorate. Based on the situation of handling criminal cases of foreigners in the six months since the implementation of the revised Criminal Procedure Law, this paper puts forward some relevant problems encountered by the grassroots procuratorates in handling criminal cases of foreigners since the implementation of the new Criminal Procedure, and then discusses the relevant countermeasures.
