在我国传统的法学教学方式中,一直延续着老师教学生的模式,老师引导学生甚至控制学生的学习内容。导致学生在整个教学过程中一直处于被动地位,缺乏主动学习理论和加强实践操作能力的意识。诚然,一个优秀的法律人才不仅需要具有扎实的法学理论功底、公平正义的法治理念,更需要在现实的法律实务中有较强的工作能力。因此,在提倡法治社会的当代中国,如何培养法学专业学生的法律职业能力,成为培养卓越的法律人才需要解决的问题。模拟法庭作为一种实践教学方式可以推动学生自主学习,更好的体现了法学本科教育的要求和目标,从根本上弥补了我国传统教学的缺陷和不足。
In the traditional teaching method of law in our country, it has been continuing the model of the teacher teaching students, the teacher guides the students and even controls the students’ learning content. As a result, students have been in a passive position throughout the teaching process, lack of active learning theory and awareness of practical ability to practice. It is true that an outstanding legal person needs not only a solid theoretical foundation of law and a fair and just concept of the rule of law, but also a strong ability to work in realistic legal practice. Therefore, how to cultivate the legal professional ability of law students in contemporary China, which advocates a society ruled by law, has become a problem to be solved in training outstanding legal talents. As a practical teaching method, moot court can promote students’ autonomous learning and better reflect the requirements and goals of law undergraduate education, and make up for the shortcomings and deficiencies of traditional Chinese teaching fundamentally.
