第一章 总则第一条 为了促进我国生物技术的研究与开发,加强基因工程工作的安全管理,保障公众和基因工程工作人员的健康,防止环境污染,维护生态平衡,制定本办法.第二条 本办法所称基因工程,包括利用载体系统的重组体DNA技术,以及利用物理或者化学方法把异源DNA直接导入有机体的技术.但不包括下列遗传操作:(一)细胞融合技术,原生质体融合技术;(二)传统杂交繁殖技术;(三)诱变技术,体外受精技术,细胞培养或者胚胎培养技术.第三条 本办法适用于在中华人民共和国境内进行的一切基因工程工作,包括实验研究、中间试验、工业化生产以及遗传工程体释放和遗传工程产品使用等.
Chapter I General Provisions Article 1 These Procedures are formulated in order to promote the research and development of biotechnology in our country, to strengthen the safety management of genetic engineering work, to ensure the health of the public and gene engineering staff, to prevent environmental pollution and to maintain the ecological balance. The term genetic engineering, including the use of vector system recombinant DNA technology, as well as the use of physical or chemical methods of direct introduction of heterologous DNA into the body technology, but does not include the following genetic operations: (a) cell fusion technology, protoplast fusion (2) techniques of traditional hybridization and propagation; (3) mutagenesis techniques, in vitro fertilization techniques, cell culture or embryo culture techniques Article 3 These Procedures shall apply to all genetic engineering work carried out in the People’s Republic of China, including experimental studies , Intermediate testing, industrial production and the release of genetic engineering and genetic engineering products.
