《医疗事故处理条例》(下称《条例》) ,自 2 0 0 2年9月 1日始实施 ,《条例》对医疗事故作了如下定义 :“医疗事故是指医疗机构及其医务人员在医疗活动中 ,违反医疗卫生管理法律、行政法规、部门规章和诊疗护理规范、常规 ,过失造成患者人身损害的事故。”另外 ,在《最高人民法院关于民事诉讼证据的基本规定》中明确规定 :“因医疗行为引起的侵权诉讼 ,由医疗机构就医疗行为与损害结果之间不存在因果关系承担举证责任”。因此 ,防范和减少医疗事故和纠纷 ,就要提高检验质量 ,改进服务态度 ,避免过失 ,杜绝主观因素造成的失误。而要有效应对有关诉讼 ,必须举证有据。就医院检验科而言 ,必须做到 :确保检验结果的准确性、及时地发出报告单、完整地保存检验过程的原始记录。为了更好地向读者介绍这些方面的研究成果和工作经验 ,本刊从本期起 ,特别开辟了“医疗事故与纠纷应对”栏目。本期刊登的是本刊编辑部组织召开的“提高检验质量 ,杜绝医疗事故”专题座谈会的纪要 ,希望广大读者各抒己见 ,踊跃投稿。
The “Medical Accident Treatment Ordinance” (hereinafter referred to as the “Regulations”) has been implemented since September 1, 2002. The “Regulations” defines medical malpractice as follows: “Medical accidents refer to medical institutions and their medical personnel. In medical activities, violations of medical and health management laws, administrative regulations, departmental rules, and norms and routines of nursing care and routines, negligence caused personal injury to patients.” In addition, the Supreme People’s Court’s Basic Provisions on Civil Litigation Evidence clearly states that: ”Infringement lawsuits caused by medical behaviors shall bear the burden of proof by the medical institution on the absence of a causal relationship between medical behavior and damage results." Therefore, to prevent and reduce medical accidents and disputes, we must improve the quality of inspections, improve service attitudes, avoid mistakes, and eliminate errors caused by subjective factors. To effectively deal with lawsuits, evidence must be provided. In the case of a hospital laboratory, it is necessary to: ensure the accuracy of the test results, issue a report in a timely manner, and completely preserve the original records of the inspection process. In order to better introduce readers to these aspects of research results and work experience, this issue has opened a special section on “Medical Incident and Dispute Response” from this issue. In this issue, the main symposium on “Improving Inspection Quality and Preventing Medical Accidents” organized by the editorial department of the journal was published, and it is hoped that readers will express their opinions and actively contribute.
