传媒与司法之间存在着对立统一的关系。媒体对司法机关的监督,有利于实现阳光下的审判,推动司法进步;但如果媒体监督不当又会对司法独立产生消极影响,造成两者之间的冲突。在媒体监督与司法独立之间,要以促进司法公正为契合点,建立新闻媒体对司法监督的相应制度,使得媒体对司法权的监督有章可循,只有这样新闻自由与司法独立才可能达成一致,从而实现二者共同追求的价值目标——实现社会公平正义。
There is a unity of opposites between the media and the judiciary. The media’s supervision over the judiciary is conducive to realizing the sunshine trial and promoting judicial progress. However, if the media is not supervised properly, it will have a negative impact on the independence of the judiciary and create a conflict between the two. Between the media supervision and the independence of the judiciary, the corresponding system of judicatory supervision by the news media should be set up by promoting the judicial fairness, so that the supervision of the judicial power by the media can be followed only if such freedom of the press and independence of the judiciary can be reached So as to realize the value goal that the two pursue together - to realize social fairness and justice.
