发展慈善事业,可以组织调动社会资源,调节贫富差距,缓和社会矛盾,是完善社会保障体系的必要补充。而我国慈善事业面临着身份、公信力、平台诸多困境。本文在分析完上述困境以及我国慈善事业滞后的传统渊源以及现代渊源后,结合我国的实际情况,提出进一步完善和发展慈善事业的几点建议:尽快制定中国发展慈善事业的基本法;更改慈善法人设立的“双重许可”原则;完善慈善捐赠监督机制。
Developing philanthropy can organize the mobilization of social resources, adjust the gap between the rich and the poor and ease social conflicts, which are necessary supplements to improve the social security system. The charity in our country is faced with many difficulties such as identity, credibility and platform. After analyzing the above predicament and the traditional origins and the modern sources of lagging philanthropy in our country, this paper puts forward several suggestions to further improve and develop philanthropy according to the actual situation of our country: to formulate the basic law of China’s philanthropy development as soon as possible; to change the establishment of charity legal person “Double Permit ” principle; improve charitable donation supervision mechanism.
