本文主要探讨了创意产业的定义以及它在经济、管理、创新和知识产权四个方面的影响和启示。作者认为人类正从信息社会逐渐步入一个注重思想和个人原创能力的新社会。创意产业的日趋繁荣是其重要特征。创意产业的概念源自20世纪90年代早期的澳大利亚。90年代后期被英国政府大加推广。但是,隶属于英国政府文化、传媒、体育部的创意产业署在大力推广中,却将“创意”一词的范畴缩小至那些具有艺术或文化倾向的产业,以及少量计算机电子产业,并将知识产权局限于版权,忽略了专利、商标和设计。作者不能认同这种做法,主张应将“创意产业”定义为脑力劳动占主导地位、劳动成果拥有知识产权的产业。究其影响和启示,创意产业经济的增长在很大程度上根本改变了当代经济的特点,尤其是在政府和企业关系方面。在结语中,作者指出最亟须解决的问题是对创意、创新进行全面、综合的准确定义,并制定明确的知识产权战略以及综合一体的鼓励创意的政策。
This paper mainly discusses the definition of creative industry and its impact and enlightenment on four aspects of economy, management, innovation and intellectual property. The author believes that mankind is gradually entering a new society focusing on thinking and personal original ability from the information society. The growing prosperity of creative industries is an important feature. The concept of creative industries originated in Australia in the early 1990s. The late 90s was greatly promoted by the British government. However, under the vigorous promotion of the Creative Industries Department under the British Government’s Culture, Media and Sports, the scope of the term “creative” has been narrowed down to those industries with artistic or cultural tendencies, as well as a small amount of computer and electronics industries, and knowledge Property rights are limited to copyright, ignoring patents, trademarks and designs. The author can not agree with this practice and advocates that “creative industries” should be defined as the industries in which intellectual work is dominated by mental work and the fruits of labor are intellectual property. Investigating its implications and implications, the growth of the creative industries economy has largely changed the characteristics of the contemporary economy, especially in the relations between the government and the enterprises. In conclusion, the author points out that the most urgent problem to be solved is the comprehensive and comprehensive definition of creativity and innovation, as well as the formulation of a clear intellectual property strategy and an integrated policy of encouraging creativity.
