在强制医疗实施过程中,强制医疗的期限是一个亟待解决的问题。强制医疗不等于无限期的终身监禁。当前,我国刑事诉讼法对强制医疗期限采取的是绝对不定期的方式,对强制医疗的期限不作任何规定。不定期的方式导致出现无限期关押和治疗时间过短或过长的问题。我国强制医疗期限应当建立相对不定期的强制医疗制度。
In the process of compulsory medical treatment, the deadline of compulsory medical treatment is a problem to be solved urgently. Compulsory medical treatment does not mean indefinite life imprisonment. At present, the criminal procedure law in our country takes an absolutely unscheduled approach to the term of compulsory medical treatment and does not make any stipulations on the duration of compulsory medical treatment. Irregular methods have led to problems of indefinite detention and treatment that are either too short or too long. Compulsory medical treatment in China should establish a relatively unscheduled compulsory medical system.
