随着科技体制改革的不断深入和发展，科技人员流动对促进科技成果转化，高新技术产业化，人才分流，实现科技资源优化配置，发挥着重要的作用。但是科技人员流动中，也有少数承担国家重要科技计划项目的科技人员离职后侵犯原单位的知识产权和技术权益，特别是原单位的技术秘密。有些单位采取非正常途径，挖掘人才，破坏正常的市场竞争秩序。因此，笔者认为：在鼓励人才流动的前提下，应当明确技术保密与技术权益的法律界限，保护国家、单位和个人的合法权益。
With the deepening and development of science and technology system reform, the flow of scientists and technicians plays an important role in promoting the transformation of scientific and technological achievements, the industrialization of high-tech industries, the diversion of talents, and the optimal allocation of scientific and technological resources. However, in the flow of science and technology personnel, there are also a small number of scientific and technical personnel who undertake projects of major national science and technology projects that violate the intellectual property rights and technical rights and interests of the original units after their departure, especially the technical secrets of the former units. Some units take abnormal channels to tap new talent and undermine normal market competition. Therefore, the author believes that under the premise of encouraging the flow of talents, the legal boundaries of technical secrets and technical rights and interests should be clarified and the legitimate rights and interests of the state, the units and individuals should be protected.
