三、绝育 1.绝育失败估计在美国每年约50,000妇女实行绝育,失败率大约为4‰。一些案例上诉指控绝育失败是由于医生手术操作失误而致。在ACOG调查中,1,449名受指控的妇科医生中,绝育失败占137名(9.5%)。输卵管绝育术,即使无操作失误,也有失败的危险。因此医生必须在术前告诉患者手术的失败率以及手术的危险和绝育的利弊。签署明确的手术同意单不一定能阻止诉讼,但在辩护中极有益。
Sterilization 1. Failure to Sterilization It is estimated that about 50,000 women are sterilized each year in the United States, with a failure rate of about 4 ‰. In some cases, the allegation of sterilization failure failed because of a doctor’s surgical procedure. Of the 1,449 alleged gynecologists in the ACOG survey, 137 failed to complete sterilization (9.5%). Tubal sterilization, even without operational errors, also have the risk of failure. Therefore, doctors must preoperatively tell patients the failure rate of surgery as well as the risks of surgery and the pros and cons of sterilization. Signing a clear consent form may not prevent the lawsuit, but is extremely helpful in the defense.
