文章从几个案例分析入手,分析了判断专利申请文件修改超范围时的判断原则和应该注意的几点问题。笔者根据专利法第三十三条的解读,结合《专利审查指南2010》中的具体规定,尤其针对根据附图的修改、表述不一致的修改这两种典型的修改方式,并结合实际案例分析了判断主体及判断原则的具体应用,希望能对申请人和专利代理人在进行专利申请文件的修改以及对审查员在判断修改超范围时提供一定的帮助。
The article starts from several case studies and analyzes the judging principles and some problems that should be noticed when judging patent application documents to modify over-range. Based on the interpretation of Article 33 of the Patent Law and the specific provisions in the Guide to Patent Examination 2010, the author especially revises the two typical modifications that are inconsistent with the amendments to the accompanying drawings. Based on the analysis of the actual cases Judgment of the main application and the specific application of the principle of judgment in the hope that the applicant and the patent attorney can modify the patent application documents and provide some help to the examiner in judging and modifying the out of range.
