各国由于刑事政策不同,累犯概念、累犯的构成要素和对累犯的处罚措施均存在重大的差别。我国刑法对累犯采取主观与客观相统一的累犯概念,将累犯分为一般累犯和特别累犯,对累犯的处罚均采从严制裁的政策。借鉴国外的累犯制度,我国累犯制度在未成年累犯、法人累犯、累犯的处罚等诸多方面均有进一步完善的必要。
Because of different criminal policies, the concept of recidivism, the components of recidivism and the penalties for recidivism are all significantly different in different countries. The criminal law of our country adopts the concept of recidivism that the recidivists have the unification of subjective and objective. It divides the recidivists into general recidivists and special recidivists, and imposes strict sanctions on the recidivists. Drawing lessons from the overseas recidivism system, the system of recidivism in our country is necessary for further improvement in many aspects, such as juvenile recidivism, legal recidivism and recidivism.
