资产证券化是20世纪70年代以来最重要的金融创新之一,它通过巧妙的设计,将流动性差的资产转换为流动性好的债券,借以融通资金。“如果有一个稳定的现金流,就将它证券化。”这是流传于美国华尔街的一句名言。如今,这个被学术界呼吁了多年、金融界盼望了多年的创新业务——资产证券化终于在我国走向了前台。本文肯定了资产证券化在我国发展的意义,并针对其在我国发展存在的法律问题提出了相应的对策。
Asset securitization, one of the most important financial innovations since the 1970s, cleverly designed funds to convert illiquid assets into liquid bonds. “If there is a stable cash flow, it will be securitized. ” This is a famous saying circulated in Wall Street in the United States. Today, this is called for many years by the academic community, the financial community has been looking forward to many years of innovative business - asset securitization finally in the forefront of our country. This article confirms the significance of the development of asset securitization in our country and puts forward corresponding countermeasures for its legal problems in the development of our country.
