中国政府网日前转发了《国务院关于修改和废止部分行政法规的决定》。其中,《铁路旅客意外伤害强制保险条例》将于2013年1月1日起废止。同时,《铁路交通事故应急救援和调查处理条例》第三十三条也被删除。据了解,《铁路旅客意外伤害强制保险条例》规定铁路旅客一律参加强制保险,且保险费含于票价之中,这与此后实施的《保险法》中,关于“保险合同自愿订立”原则相违。至于《铁路交通事故应急救援和调查处理条例》第三十三条关于赔偿责任限额之规定,也与现今经济发展形势和实际情况不符,失去了施行的意义。《铁路旅客意外伤害强制保险条例》于
