改革企业用工制度、优化劳动组合,是目前深化企业改革进程中的一项重要措施。它给企业注入了新的动力和生机,引起了人们的极火关注,被誉之为“经济改革进一步深化的契机”和“突破口”。本文试就企业优化劳动组合的有关理论问题,尤其是法律调整和法律保障问题进行初步探讨。一什么是优化劳动组合?对此一直没有一个完整统一的科学表述。有三种不同的观点:第一种观点认为优化劳动组合的提法不科学,不符合我国国情。理由是:“优化”的反义词就是“劣化”,这样容易使人产生联想而引起不应有的消极影响,优化组合应该叫“合理组合”。第二种观点认为,优化劳动组合是指在企业内部以提高经济效益,促进生产力发展为目标,以优化组织结构为重点,通过竞争选择优质劳动者上岗,精简办事机构的一种科学的劳动管理制度。第三种观点认为优化劳动组合就是劳动者与使用单位根据生产和工作的需
Reforming the employment system and optimizing the labor portfolio are important measures in deepening the reform of the enterprise. It injected new impetus and vitality into the enterprise, aroused people’s extreme attention and was praised as “an opportunity for further deepening economic reform” and a “breakthrough point.” This paper tries to discuss the theoretical issues concerning the optimization of labor portfolio in enterprises, especially the legal adjustment and legal guarantee. What is the optimal labor mix? There has been no complete and unified scientific statement. There are three different viewpoints: The first one holds that the formulation of the optimal labor portfolio is unscientific and does not conform to China’s national conditions. The reason is: “Optimization” is the opposite of “deterioration”, so easy to make people associate and cause unwanted negative effects, the optimal combination should be called “reasonable combination.” The second view is that the optimization of labor portfolio refers to within the enterprise in order to improve economic efficiency and promote the development of productive forces as the goal, to optimize the organizational structure as the focus, competition through the selection of high-quality workers to work to streamline the office of a scientific labor management system.
