关于财产保险合同转让的条件,目前理论界与实务界有两种观点,一是财产保险合同随保险标的的转让而自动转移,二是财产保险合同的转让要得到保险人的同意。本文将对以上两种观点的合理性进行分析,来探讨目前我国财产保险合同的转让是否需要以及需要什么条件。
With regard to the conditions for the transfer of property insurance contracts, there are two views in theory and practice at present: first, the property insurance contract is automatically transferred with the transfer of the subject matter of insurance; second, the consent of the insurer is required for the transfer of the property insurance contract. This article will analyze the rationality of the above two points of view to explore whether the transfer of China’s property insurance contract needs and what conditions are needed.
