在英美法中,滥用法律诉讼(misuse of legal process)可以构成一种独立的民事侵权行为责任。在这些情况下,原告可以提起滥用法律诉讼的侵权行为诉讼,从被告那里获得补偿。一般而言,存在三种“法律诉讼的滥用”的情况,即恶意刑事起诉、恶意地提起民事诉讼以及其它的诉讼滥用,因此也就存在三种滥用法律诉讼的侵权行为形式,。
In Anglo-American law, abuse of legal proceedings can constitute an independent liability for tort. Under these circumstances, the plaintiff may file a lawsuit for abusing the lawsuit for infringement and receive compensation from the defendant. In general, there are three cases of “abuse of legal proceedings”: malicious criminal prosecutions, malicious petitions for civil actions and other abuse of litigation. Therefore, there are also three forms of abuse of legal proceedings.
