为救济保险人与投保人之间存在的保险格式条款信息不对称,我国现行保险法明确对保险人课以说明义务。立法意在保障投保人的知情权,推动保险格式条款的解释信息向投保人流动。但说明义务的规定缺失有效的实施机制,容易导致说明义务形式化,缔约环节存在的信息不对称并未有效缓解。保险格式条款缔约信息不对称的有效救济,思路上应从法律制度建构入手,路径上,应着眼于保障投保人缔约选择权,以保障投保人辨识和衡量保险格式条款所需要的时间和知识为方向。
