在涉及网络证据的专利确权案件中,真实性认定是难点和争议焦点。目前《专利法》及其《实施细则》和《审查指南》均没有对网络证据的审核认定作出特别规定,专利复审委员会在实践中一般是从网络证据的特点出发,结合双方当事人的证据提交情况和相关经验法则,综合判断作出认定。本文在对网络证据特点进行分析和比较法研究的基础上,运用实证分析的方法,对目前的审查实践中网络证据真实性的审核认定方法进行梳理并给出法理分析,旨在为建立适应我国专利确权案件审查需要的网络证据法律制度提供参考。
Authenticity is the most difficult and controversial issue in the case of patent confirmation involving network evidence. At present, neither the Patent Law nor its Regulations nor the Guidelines for Examination make any special provisions on the examination and verification of online evidence. In practice, the Patent Reexamination Board usually starts from the characteristics of online evidence and submits the evidence submitted by both parties And related rules of thumb, make a judgment based on comprehensive judgment. Based on the analysis of comparative evidence and the characteristics of evidence in the network, this paper analyzes and verifies the authenticity of the network evidence in the current review practice by using the method of empirical analysis and gives the jurisprudence analysis, Patent Right Case Review Network evidence required for the legal system to provide a reference.
