社会主义法治理念根基于党的执政理论与实践,与党的执政理念具有同构性。这种同构以法律与政治的有机统一为理论前提,表现于内容的同构,实现于价值的同构。内容同构不是简单的混同,而是“求同存异”的同构,两者内容相同但内涵各有偏重。同构党的执政理念与社会主义法治理念,对中国法治建设实践与党的执政能力建设实践具有相互影响、相互促进的双重价值。
The concept of socialist rule of law is based on the party’s governing theory and practice and has the same structure as the party’s governing concept. This isomorphism with the organic unity of law and politics as the theoretical premise, manifested in the isomorphism of the content, realized in the isomorphism of value. Content isomorphism is not a simple confusion, but the “sameness and sameness” isomorphism, both content is the same but the content of each have emphasis. The concept of governance by the isomorphic party and the concept of the socialist rule of law have dual values of mutual influence and mutual promotion in the practice of the construction of the legal system in our country and the construction of the governing capability of the party.
