党的十八届四中全会提出了全面推进依法治国的总目标,对当前的法治建设水平和依法治理能力提出了更高要求。尤其在推进依法行政方面,进一步强调要坚持严格规范公正文明执法。本文从反思现阶段烟草专卖执法活动着手,将当前的刚性强权管理进行柔性化处理,保持管理活动的和谐稳妥,通过阐述行政指导在烟草专卖管理中的意义与适用原则,进而对其许可管理中具体应用进行探索,以期为完善烟草专卖管理提供有益参考。
