北京大学法学院王锡锌教授在《信息公开的制度实践及其外部环境——以政府信息公开的制度环境为视角的观察》一文中提出,我国现行的《政府信息公开条例》第八条“行政机关公开政府信息,不得危及国家安全、公共安全、经济安全和社会稳定”存在逻辑矛盾。本条是关于政府信息公开应当维护公共利益的规定。但换个角度来看,这却是有关政府信息不得公开的
Professor Wang Xizhen from Law School of Peking University put forward in his article “The Institutional Practice of Information Disclosure and Its External Environment - From the Perspective of the Institutional Environment of Government Information Disclosure”, the article 8 of the “Regulations for the Disclosure of Government Information” “Administrative organs should disclose government information without jeopardizing national security, public security, economic security and social stability.” There are logical contradictions. This article is about the government information disclosure should safeguard the public interest provisions. But from another point of view, this is the relevant government information must not be made public
