商标经过一定期间使用,为特定地域范围内公众所熟悉,享有较高社会声誉,经有关机关确认后便成为驰名商标。按是否已注册来分,有注册的驰名商标和未注册的驰名商标。根据《保护工业产权巴黎公约》的规定,驰名商标无论是否已注册都应一律受到特别保护。我国已加入巴黎公约,负有履行该公约的义务,但我国国内立法对驰名商标的特别保护几乎是空白。《商标法》只能对已注册的驰名商标进行一般的保护。《反不正当竞争法》第五条第二项禁止经营者擅自使用知名商品特有的名称、包装、装璜,或者使用与知名商品近似的名称、包装、装璜,造成和他人的知名商品相混淆,使购买者误认为
After being used for a certain period, the trademark is familiar to the public in a specific geographical area and enjoys a high social reputation. After being confirmed by the relevant authorities, the trademark becomes a well-known trademark.
