体验式教学能够有效提高卓越法律人才的实践能力和素养。与案例教学、模拟法庭和诊所式法学教学相比,具有主体的亲历性、过程的全程性、受体的广泛性的特点。体验式法学教学强调学生的自主解决问题能力的培养,实施过程依靠多种角色的扮演和多个环节的置,以及多种标准的评价,强调案例的原始化和教师的全程参与与控制。当然对于其表现出的缺点,如学时过长、评价标准过于主观化的倾向,仍有待探讨和克服。
Experiential teaching can effectively improve the practical ability and accomplishment of outstanding law talents. Compared with case teaching, moot court and clinic law teaching, it has the main body’s own experience, the whole course of the process and the extensive characteristics of the recipient. Experiential law teaching emphasizes the cultivation of students’ ability to solve problems autonomously. The implementation process relies on multiple roles and multiple links, as well as evaluation of multiple standards, emphasizing the initialization of cases and the full participation and control of teachers. Of course, there are still some issues to be discussed and overcome in respect of the shortcomings of their performance, such as too long class time and too subjective assessment criteria.
