首先概述了企业知识产权保护的现状,主要是以专利为例。然后介绍了企业知识产权保护存在的灰色地带,主要有网络技术的缺乏引起的网络安全问题;平行进口问题和起因重科技成果轻申请专利。进一步分析由于技术灰性、立法灰性和认知灰性导致灰色地带的存在。最后从应用网络技术、规范和完善知识产权保护制度和立法、注重企业自主知识产权的形成,增强企业知识产权保护意识三个方面管理企业知识产权保护的灰色地带。
First outlines the status of corporate intellectual property protection, mainly patents. Then introduced the gray areas of the enterprise intellectual property protection, there are mainly network security problems caused by the lack of network technology; parallel import problems and causes of serious scientific and technological achievements light patent applications. Further analyze the existence of the gray zone due to the technical ashes, the legislative ashes and the cognitive ashes. Finally, from the application of network technology, regulate and improve the intellectual property protection system and legislation, pay attention to the formation of independent intellectual property rights and enhance the protection of intellectual property rights of enterprises from three aspects of managing the gray area of intellectual property protection.
