《劳动合同法》的颁布实施已有三年之久,对《劳动合同法》会不会伤害劳动者利益以及是否会伤害企业竞争力的争论早已进入白热化。《劳动合同法》的初衷是为了保护劳动者的合法权利以及提高企业的可持续竞争力,所期望达到的即是和谐的劳动关系,这一双赢的目的。本文旨在以《劳动合同法》中的解雇制度为视角,来探讨国家对用人单位在劳动关系中的管制。
The “Labor Contract Law” has been promulgated and implemented for three years. The controversy over whether Labor Contract Law will harm the interests of workers and whether it will hurt the competitiveness of enterprises has long been heated. The original intention of the Labor Contract Law is to protect the legal rights of workers and enhance the sustainable competitiveness of enterprises. What is expected to achieve is the win-win objective of harmonious labor relations. The purpose of this paper is to explore the state's control of employers in labor relations from the perspective of layoffs in the Labor Contract Law.
