言论自由与人格权保护的冲突问题之所以经久不衰,其原因就在于,言论自由的保障没有一个切实可行的尺度。要解决这一问题,需在明确言论自由与人格权权利位阶的前提下,进一步考虑具体人格权保护中,言论自由的尺度。对此,应在借鉴域外经验教训的基础上,构建我国人格权与言论自由冲突调和的机制,充分考虑特殊因素导致的例外规定及各因素考虑顺序,使言论自由的尺度更具操作性。
The reason why the conflict between freedom of expression and protection of personality rights is enduring is that the guarantee of freedom of speech does not have a realistic scale. To solve this problem, it is necessary to further consider the criteria for the protection of individual personality and the freedom of speech on the premise of clarifying the level of freedom of speech and right of personality. In this regard, we should draw lessons from extra-territorial experience and lessons learned, and build a mechanism for the reconciliation of personality rights and freedom of speech in our country. We should give full consideration to the exceptional provisions and the order of consideration of various factors and make the standard of freedom of speech more operative.
