职务违纪违法是指国家机关从事公务人员利用职务、职权、地位或工作的便利条件,违反纪律、法律法规,滥用职权,徇私舞弊,收受贿赂,玩忽职守,侵犯公民人身权利,以及国家、集体、公民财产权利,破坏国家机关正常管理活动的行为。江泽民总书记严肃指出,司法腐败是最严重的腐败,要丢掉幻想,准备斗争。显然,当前共同探讨、研究预防、减少公安民警刑讯逼供、非法拘禁、体罚虐待人犯、徇私舞弊、贪赃枉法、贪污受贿、玩忽职守、滥用枪支警械致人伤亡等职务违纪违法问题,具有重大现实指导意义。一、公安民警职务违纪违法案件种类从近几年来发生的案件看,公安民警职务违纪违法案件大体有以下几类:(一)侵权型。有的公安民警以执法者自居,破案心切,对被审查的犯罪嫌疑人动手动脚,体罚虐待.甚至刑讯逼供,致人伤残或死亡;有的民警地
