马航MH370航班坠毁引发了国际社会的普遍关注。坠毁事件涉及到的主体数量之多、涉事各方态度及责任的模糊不清、搜救及打捞过程之复杂、查清坠毁原因困难重重、索赔涉及到的法律及程序繁杂,均创下历史新纪录。仔细梳理航班失事的全过程,对飞机坠毁索赔可能涉及到的诉讼主体、法律适用、索赔项目和金额、诉讼管辖等问题进行深入探讨,既是对死者的交代,也是对生者的慰藉。
Malaysia Airlines Flight MH370 crashed into widespread concern of the international community. The number of parties involved in the crashes was so high that the attitude and responsibilities of the parties involved were ambiguous. The search, rescue and salvage process was complicated. It was difficult to find out the causes of the crashes and the complex laws and procedures involved in the claims, setting a new record in history . Carefully combing the whole process of the flight crashes, the subject of the lawsuit that may be involved in the claim for the crash of the aircraft, the application of the law, claims items and amounts, and the jurisdiction of the proceedings are discussed in depth. This is both an account of the deceased and a consolation for the survivors.
