政府投资作为国家调节经济的最直接方式被各国政府广泛采用,政府作为一国最高行政机关,肩负协调、稳定国家整体经济形势的职责。政府的一切权力来源于法律的授权,政府投资作为国家经济调节权的实现方式,也要接受法律的约束。在社会主义市场经济条件下,政府投资范围应限于市场失灵范围内。文章主要从世界各国政府投资实践比较角度进行了分析,同时,也分析我国政府投资的现状和存在的问题并在通过我国政府投资范围领域进行再界定的原则上完善了政府投资法律制度。
As the most direct way for a country to regulate its economy, government investment is widely adopted by governments. As the highest administrative organ of a country, the government shoulders the responsibility of coordinating and stabilizing the overall economic situation of the country. All the power of the government comes from the authorization of the law. The government investment, as the way to realize the economic regulation power of the country, must also be bound by the law. Under the condition of socialist market economy, the scope of government investment should be limited to the scope of market failure. At the same time, it also analyzes the status quo and existing problems of government investment in our country and perfects the legal system of government investment on the principle of redefining the scope of government investment in our country.
