国内社会与国际社会、国内法与国际法以及国内法学者与国际法学者之间的重要差别,从根本上决定了国际法学者参与国际法实践的可能性、范围、程度以及方向均有别于参与国内法实践的国内法学者,并且正在发挥重要的变化。国际法学者可能发挥澄清甚至创设国际法、倡导改革国际法、参与适用国际法,以及臧否国际法的作用。以往,国际法学者在中国国际法实践中的作用整体来说并不重要。晚近以来,随着国际法治、国内法治的不断推进以及中国的崛起,中国国际法学者的作用正在获得重视。中国政府已经采取一些措施促进国际法学者参与国际法实践,国际法学者更多地参与国际法实践对于中国实现“增强我国在国际法律事务中的话语权和影响力”的战略至关重要。
